Register My Trademark

Once you have done a trademark search and found that there are no conflicting trademarks in your industry, the Moore Legal Group can prepare and file a trademark application for your business name, brand or logo. Registering a trademark with the United States Patent and Trademark Office (USPTO) gives the owner of the trademark registration exclusive nationwide rights to use the name, brand, or logo in question. No one else can use or register a confusingly similar name, brand or logo after your filing. If they try to do, they may be stopping from doing so.

Our Register My Trademark service includes:

  • Your federal trademark application prepared by a trademark attorney

  • Application sent to you within 5 business days for your approval

  • Once approved by you, the application is then filed electronically with the U.S. Patent & Trademark Office

It is critical to submit the proposed trademark or business name for a Comprehensive Trademark Search. A comprehensive search is the first step in determining the uniqueness of your mark, and its similarity to other, pre-existing marks. Wrongfully registering or using a trademark already in use could result in lawsuits from other companies claiming trademark infringement. A clearance search will also determine whether the proposed trademark or business name is available to be used in the first place, saving you valuable time and money.

Do a Complete Search and Register My Trademark
This is the most prudent way to proceed in protecting and registering your trademark. This service combines the Comprehensive Trademark Search and the Register My Trademark services. Attempting to blindly register your trademark may seem less expensive on the front end, but if the mark is too similar to pre-existing registrations, or is already in use in commerce elsewhere, the USPTO will simply reject its submission.

Though we suggest the Comprehensive Trademark Search to save time, and potentially lost money in USPTO and service fees, we will be happy to conduct a basic search for you in the USPTO database. Usually we provide search results within three (3) business days.
Monitor My Trademark

Registering your federal trademark with the United States Patent and Trademark Office (USPTO) is just the first step. The USPTO does not necessarily inform you that your trademark is about to expire, or of other maintenance requirements that may apply to your mark. The USPTO also has no obligation to police the streams of commerce to determine whether your trademark rights have been infringed. Though trademark protection can be indefinite, it is not so without continued maintenance. To prevent the loss of your trademark protections, it is imperative that your mark should be closely monitored.  

If others begin using your trademark, and you do nothing to stop it, you have already begun the legal process of losing your rights to that mark. Early detection of potential trademark infringement is vital. The failure to properly defend your trademark against trademark infringers could eventually diminish the strength of your trademark to the point of abandonment and cancellation of your registration.

Copyright My Work

Copyright is the legal right granted to an author, composer, playwright, publisher, or distributor to the exclusive publication, production, sale, or distribution of a literary, musical, dramatic, or artistic work. Copyright protects you in substantive ways from those who may plagiarize your unique work.

While copyright protection technically exists once a work is reduced to writing (or any other tangible medium), a copyright must be registered with the U.S. Copyright Office before a party may sue in federal court for its infringement. Even more important, perhaps, is that those who register their copyrights immediately, or within three months of publication, can also get statutory damages and attorneys fees for any infringement. The copyright symbol “©” is only given its real teeth once the work its affixed to is registered with the U.S. Copyright Office.  Our fee for the Copyright My Work service includes all applicable federal filing costs and expenses.

  • Sound recordings. Recordings of music, sounds, or words.
  • Architectural works.  Buildings, architectural plans or drawings.

Your work cannot be copyrighted unless it is recorded in some tangible, viewable form. Common information (such as calendars and rulers) cannot be copyrighted. However, if you have created an original work in any tangible form, and it has value to you or others, you need to get federal copyright protection today.

Monitoring your rights is the only way to know if someone is illegally "borrowing" or outright stealing, your creative work. Once you have copyright protection, you have the right in federal court to damages and attorneys fees for any action you must pursue to enforce that right.
